Our law firm only handles adoption cases involving step-parent adoptions. Such is in a case where a parent has remarried, and the biological parent is willing to consent to the new spouse adopting a child, or the biological parent has passed away, where the biological parent has abandoned the child.
Sometimes we have cases when a parent leaves the country and has absolutely no contact the child, and sometimes have no way of knowing if the parent is even alive. I’ve even handled step-parent adoptions where the mother was raped and had no way of knowing with a biological father was. The person was never prosecuted.
So, if you do know who the biological father is, and where the biological father is, the only way to proceed with a step-parent adoption is if the biological father legally consents to the adoption by the step-parent.
In very limited cases there may be situations where the step-parent adoption can proceed if a court has legally stripped the biological father of his parental rights. If extreme circumstances exist and you wish to have the biological father’s parental rights legally taken away, you can file a motion for termination of parental rights. Usually, the termination of prayer rights is filed in handled by the state Department of Children and Family Services. If you choose to take this step, it will not be a quick process. The Department of Children and Family Services takes termination of parental rights cases very seriously and undergo a very lengthy and thorough process to determine if they should make a recommendation for the termination of parental rights.
There is a private way in the legal system to seek the termination of parental rights, but the burden of proof and evidence, not to mention the hefty cost and financial burden will be solely on you.
