In the state of Florida, what used to be known as child visitation is now time-sharing. Time-sharing refers to how much time the child will spend with each parent. Just as each family differs from one to another, every time-sharing plan will be different as well. In Polk County Florida, getting a 50/50 split in time-sharing between each parent in the child they are more difficult to achieve an Orange County or Hillsborough County Florida, as those counties appear to be progressive and Polk County Florida.
When both parents want a 50% to 50% split in time-sharing, our goal is to successfully achieve such an arrangement to be approved by the court. In Polk County Florida, when a father can get 42% time-sharing with the child vs. 58% for the mother, that may often be the best possible arrangement that can be achieved in Polk County. When we represent fathers, we will often recommend that he accepts the 42% time-sharing when available.
Family law courts throughout the state of Florida, have adopted model parenting plans with time-sharing schedules in them.
Time-sharing schedules include:
- Time-Sharing Schedule Model 1: 73% time-sharing for one parent to 27% time-sharing for the other parent. This model is your typical scenario of the child being with one parent every other weekend, Friday and Saturday night, and one evening per week for a couple of hours, and holidays being split 50 / 50, and the 10-week summer is split 50 / 50. Model 1 can be adapted for the needs and schedules of all involved, such as the normal weekend the child is scheduled to be with the other parent may start on Thursday Night and run through Sunday night. This provides the same time-sharing split, only condensed into a single window of time.
Model 1 may also include a 58% time-sharing for one parent to 42% time-sharing for the other parent. The typical scale would be Friday night through Monday morning, plus one overnight every week, and a weekend every other weekend. and holidays being split 50 / 50, and the 10-week summer is split 50 / 50.
- Time-Sharing Schedule Model 2: 50% time-sharing for one parent to 50% time-sharing for the other parent. There are various ways to come up with a 50% to 50% time-sharing plan. With younger children, the court likes to see consistent contact with both parents for the child. This type of parenting plan is often referred to as a rotating parenting plan, where the specific days or even the week, as a whole, will be one set schedule where the days the child spends with each parent will simply swap from week to week.
- Time-Sharing Schedule Model 3: When one of the parents live further than 50 miles from the child or out of state. The time the out-of-state or out-of-area parent will have with the child will be greatly reduced. These types of time-sharing schedules can be much more complicated and include periods of visitation over spring break, half of the winter break, every other Thanksgiving break, or 6 weeks of the 10-week summer break from school. That parent also has the right to visit the child one weekend a month if they want and travel to the area where the child primarily lives. This type of parenting plan is referred to as a “non-local parenting plan.”
There are also safety-based parenting plans for when one of the parents poses a risk of harm to the child, in which case, these visits would be supervised and greatly restricted.
